18. Can we rely on a new development
of the European social action?

Brian Bercusson knew how to share his constantly renewed interest with
his students, of which I was part, in the development of European social
law that he analysed in a critical and constructive way. He thought this
interest was intimately linked with the knowledge he had of the social
actors involved and their ability to act to reinforce social rights and soli-
darity links in Europe.
Indeed, his courses at the European University Institute (EUI) in
Florence were not only aimed at acquiring or strengthening knowledge of
European labour law but also at familiarising us with the training context
and changes in this law, `the law in context', which must refer to the ways
in which those (in particular social partners) involved in its creation or
implementation work.
This is how after benefiting from Brian's seminars over several years I
had the opportunity to really discuss and exchange ideas with him on the
content of his proposed `posting of workers' directive when I worked at
the European Commission and administered the directive in question. He
was enthusiastic about the idea of adopting a directive aimed at combating
the social dumping aspect of the posting of workers and the specific legal
knowledge he gave to European trade unions always made a contribution
to progress in the writing of the text of the directive.
