Abstract/Description:
The action taken by the European Community in the field of intellectual property has focused mainly on the harmonization of national substantive law and the creation of a unitary right at Community level. Certain national intellectual property rights, such as trademarks, designs, patents for biotechnological inventions and certain aspects of copyright and related rights, have been harmonized. The Community has also created some unitary rights at Community level such as the Community trademark and, more recently, Community designs. Discussions are also under way with regard to creating a European Union patent, but I must confess I feel somewhat bewildered on this last topic.
