Foreword
The role of European judiciaries including national and European
courts and tribunals has gained relevance and it is at the core of
recent developments following the Stockholm Programme. The
post-Lisbon institutional set up is producing new equilibria within
the judiciary and between judicial, legislative and executive powers.
Courts play a major role as both legal innovators and system sta-
bilizers. The quality and effectiveness of their activities depends on
the collective action and on the forms of dialogue and cooperation
taking place both within judiciaries and between judiciaries and
other institutions. Legal evolution is not the task of a single institu-
tion but the outcome of collaborative commitment of several insti-
tutions. The investigation of new forms of dialogue between courts
that favour the protection of citizens' rights and constitutional iden-
tities is at the core of the new series with Edward Elgar, which will
host contributions of both theoretical and practical relevance. The
project aims at consolidating the relationships between academics
and judges engaging both communities in a debate over the role of
the judiciary in European and Global governance.
We are very pleased to start the new Elgar series on judicial coop-
eration with a volume published by the Network of the Presidents
of the Supreme Judicial Courts of the European Union. The series
is an innovative project that links academics and judiciaries in a
common endeavour to investigate and debate issues related to the
role of judiciaries in legal development and innovation. It stems
