PART I
Framing the search for environmental justice
In this first section we explore perspectives of scholars and judges upon
the fundamental nature of environmental justice, and key characteristics
of the search for its meaning and its application. The voices heard in
this section are of Brian Preston, whose experience as an environmental
law judge supports his precise framework for analyzing what is required
through the law to deliver environmental justice in practice. Klaus
Bosselmann provides a scholar's perspective upon the changing nature of
the challenges that must be met if environmental justice is to be achieved
through environmental law. Lee Godden and Emily O'Connell consider
how innovative environmental policy instruments might in themselves
give rise to significant issues of ecological and human justice. These three
chapters help to frame the discussions in the chapters that follow.
