Abstract/Description:
This chapter provides an analysis of debates on the international criminal responsibility of multinational corporations (MNCs) where their activities constitute, or contribute to, international crimes, exploring the role that international criminal law can play to end impunity and to sanction human rights violations by MNCs. Section 1 maps the terrain, identifying ways in which MNCs have been implicated in international crimes and the reasons why international criminal law is being seen as a corporate human rights enforcement tool. Section 2 addresses the individual criminal responsibilities of private individuals, identifying the major issues that arise in respect of such duties in business settings. Section 3 then discusses controversies related to corporate duties under international criminal law. While uncertainties remain, the application of international criminal law is likely to be increasingly explored in the context of business wrongdoing in conflict zones, at least so long as international criminal law remains an integral part of international responses to conflict.
