Abstract/Description:
Insolvency proceedings, including discharge of debts, are predominantly regulated under Czech law by the Insolvency Act. According to the Insolvency Act, both natural persons and legal entities may be subject to bankruptcy proceedings. On 1 July 2017, an amendment took effect and brought about several modifications: this amendment introduced new conditions on who may submit and draft a motion for debt relief proceedings, looked to promote delivery via data mailbox, modified the rules on the appointment of trustees in debt relief proceedings, and strengthened the supervisory role of the Ministry of Justice of the Czech Republic over trustees’ functions.
