Abstract/Description:
The regime governing the over-indebtedness of individuals was inserted into the Consumer Code in 1993. The Code has been regularly amended since that date and, as a result of an order on the 14th March 2016 which looked to streamline and enhance the legal consistency of its provisions, we have now entered a period of recodification. Today, the system favours non-judicial settlements. There is only one procedure available; this commences with the voluntary submission of a file by the individual to the Secretariat of the Bank of France, who will then decide whether or not to admit the individual to proceedings, pending his or her further approval.
