Abstract/Description:
The decisional practice of the European Commission in the field of merger control in the pharmaceutical sector is particularly extensive. A wealth of deal investigations and enquiries have led the European Commission to a very granular and sophisticated way of defining markets for finished pharmaceutical products and for other ancillary markets and segments, such as the upstream markets for the out-licensing and the contract manufacturing of finished dose products, or the downstream market for the wholesale distribution and procurement of finished pharmaceuticals to customers and resellers. The pharmaceutical sector is also characterized by the singular role of R & D, the importance of public procurement and public intervention in most EU markets, and other factors that are unique. This piece therefore summarizes and analyses the appraisal of competition and the assessment of merger remedies and commitments in the pharmaceutical sector.
