Abstract/Description:
UK competition law in its current form is relatively young, given the Competition Act 1998 only came into force in 2000. In that time, we have seen several interventions by the O_ce of Fair Trading, now the Competition and Markets Authority, in the pharmaceutical sector, including early cases relating to exclusionary abuse of dominance, more recent investigations into pay-for-delay and high-profile cases into excessive pricing. We survey in this chapter the iteration of cases over the years and comment also on the e_orts by the competition authority to influence Government policy in the sector. Even in the course of writing this chapter, developments have continued apace and this sector can expect to remain in sharp focus – not a surprise given its importance to society, the fact that the State is the customer, and the challenges arising from the acute intersection of IP and antitrust in the pharmaceutical world.
