Abstract/Description:
This chapter analyzes China’s laws, antitrust enforcement, and decisional practice with regard to competition and trade in the pharmaceutical sector. The work covers key developments, legislation and enforcement relating to pharmaceutical and medical device pricing, vertical supply agreements, horizontal collaboration agreements, and abuse of a dominant position or administrative monopoly. This chapter also covers merger control practices and considerations in China, including significant remedies decisions in the pharmaceutical and medical device sectors, and unique features of China’s merger control process, including its consideration of national economic development and industrial policy in evaluating the domestic impact of a transaction.
