Abstract/Description:
Labour market regulation is undeniably one of the key factors affecting the dynamically evolving phenomenon of precarious work in Europe. Yet, in the EU labour law architecture, 'precarious work' does not stand as an autonomous legal concept and the references to precariousness in both the European Union legislation and in the case law of the Court of Justice are still rather rare. The chapter provides an overview of the underlying causes of the development of the precarious work phenomenon in Europe and analyses the policy and judicatory answers to it at EU level. It also discusses the perspectives for and potential trajectories of the development of an adequate institutional framework against precarity at the EU level.
