Abstract/Description:

This chapter focuses on the international criminal trials conducted by the International Criminal Tribunal for the former Yugoslavia (ICTY), and the discrepancy between their largely positive global image, as opposed to their domestic perceptions within each of the former Yugoslav - now independent - states. The Tribunal contributed to the creation of a ‘winners’ memory’ in Croatia, a ‘victims’ memory’ in Bosnia-Herzegovina, and a ‘memory of the defeated’ in Serbia. From a targeted discussion of crucial past events, under a precise historical context, this chapter offers a valuable analysis of international criminal justice’s influence upon the political and social conscience of ethnic groups within these states, thus unveiling another facet of the intertwined relationship between international law and history.
