Book Title: Art Law and the Business of Art
Editor(s): Wilson, Martin
Publisher: Edward Elgar Publishing
Section: Chapter 5
Section Title: Ownership and authenticity
Number of pages: 25
Abstract/Description:
This chapter considers ownership and authenticity, which are the two most frequent sources of disputes relating to the sale, purchase and ownership of art. The section on title and ownership deals with the legal rights which the dispossessed owner of an artwork may have against subsequent owners or possessors of the artwork. The second part of the chapter considers the auction house’s duties in relation to the correct identification of the authorship of an artwork and the legal consequences of an artwork being found to be a forgery or to have been misattributed.
