Abstract/Description:

This chapter provides commentary on art. 10 of the CRC on family reunification. The chapter interprets the requirement to treat requests of family reunification in ‘a positive, humane and expeditious manner’ and the right to leave a country and return. The chapter also separately addresses the situation of unaccompanied or separated children, including by surveying relevant case law.
