Abstract/Description:

This chapter provides commentary on art. 12 of the CRC on the views of the child. This right is explored from various angles, including the child’s capacity to form views, the free expression of such views, which matters affect the child, the notion of due weight, the specific case of official proceedings, ways of hearing the child and fair proceedings. Both substantive and procedural aspects are tackled. The chapter also relates the child’s rights under art. 12 CRC to the concept of ‘participation’, as well as to the legal and social status of the child as a subject of rights.
