Abstract/Description:

This chapter provides commentary on art. 20 of the CRC on children deprived of their family environment. It looks both into the reasons why alternative care may be necessary and into the suitability requirements that the provision introduces for alternative care. The chapter explains how the societal debate about deinstitutionalisation has led to a legal debate on prioritisation of forms of alternative care, forcing states to consider institutional care as a measure of last resort.
