Abstract/Description:
This chapter provides commentary on art. 28 of the CRC on the right to education. It explains how the provision focuses on the right to education dimensions relevant for the child and highlights the CRC-specific reference to positive school discipline and regular school attendance. The chapter explains the nature of state obligations, the interrelated essential elements of the right, as well as its minimum core obligations. It engages with the topical issues of inclusive education for children with disabilities and Roma children, exemptions from certain courses for religious reasons, as well as access to education for undocumented migrant children.
