Abstract/Description:
This chapter provides commentary on art. 35 of the CRC on the prevention of the abduction of, the sale of or traffic in children. The chapter first inspects terminological debates around the concepts of child abduction, the sale of children and the traffic in children, including through references to other international legal documents such as the Council of Europe (CoE) Convention on Action against Trafficking in Human Beings (2005). The chapter then focuses on the prevention obligation as embodied in the article and the use of child-sensitive measures in this regard. In relation to contemporary issues, risks in the context of art. 35 in conflict and humanitarian crisis situations and in surrogacy are explored.
