Abstract/Description:
The purpose of this chapter is to present the treatment of foreign investments and the related case law of Serbian and Montenegrin. In particular, the chapter focuses on the historical roots of the current situation and the various relevant political, societal and economic processes the two countries underwent together and separately. The analysis also highlights the current legislation in Serbia regarding foreign investment: the 2015 Serbian Law on Investments and the Montenegrin 2011 Foreign Investment Law. Afterwards, the chapter looks at the publicly available case law regarding both countries to draw conclusions. The chapter aims to provide an accurate summary of the current situation of foreign investments protection in Serbia and in Montenegro, and to highlight the observable trends in the field, and to show the likely near-future of foreign investments protection in the two countries.
