Chapter 7 looks at the enforcement of GIs in Europe. This entails a detailed consideration of the Enforcement Directive (Directive 2004/48/EC) and Customs Regulation (Regulation (EU) No 608/2013). The chapter reviews civil enforcement of IP rights, criminal enforcement and enforcement by customs authorities. In relation to border enforcement it looks at the procedures concerning the suspension of the release or detention of the goods, inspection and sampling of goods whose release has been suspended or which have been detained, storage, the sharing of information by the enforcement authorities with rights holders and among Member States. The chapter looks at the destruction of goods, liabilities, costs, sanctions and penalties.
