Abstract/Description:
Protection in Bulgaria is based on the 1993 Law on Copyright and Related Rights. Intellectual property has been one of the most dynamic areas of growth for the last couple of decades and, as a result, the Bulgarian Law has been amended on several occasions since 1993. Directive 2001/29/EC was implemented with the amendments of 2002. Further amendments were adopted in 2011 which are seen as contradicting fundamental principles, such as the right of the author to receive compensation for all types of use of his work and for each subsequent use of the same type. 2011 also witnessed a major overhaul of the regimes under which collecting societies and the private copying levy system operate in Bulgaria which led to an extremely cumbersome collective rights management system. Hopes are set on the implementation of Directive 2014/26/EU with a view to streamlining the collective management system.
