Abstract/Description:
The chapter on the Czech Republic describes the transposition of Directive 2001/29/EC into the Czech legal system and several related significant aspects of the latest amendment to the Act no. 121/2000 on Copyright and Rights related to Copyright and on the Amendment of Certain Acts (Copyright Act). A special focus was given on the scope of the rights of reproduction, communication to the public/making available and distribution. In addition, the chapter introduces historically important related case law, among other a series of cases regarding spa resorts. The chapter further summarizes the transposition of exceptions into the Copyright Act as well as sanctions and remedies. A legislative outlook is given regarding the state of copyright protection activities in the Czech Republic and the potential role of the EU’s Communication on Tackling Illegal Content Online in light of the latest discussion on several noteworthy implications of the Communication at the national level.
