Abstract/Description:
The Directive 2001/29/EC has been duly implemented in the Hungarian legislation partly when the new Copyright Act was adopted in 1999 – when the Directive was still in draft stage – and partly through amendments when it had to be implemented. At the same time, the legislation and the case law also have some specific features. The Copyright Act provides for joint and several liability for non-payment of fair compensation for private copying along the entire chain of distribution from manufactures/importers to retail shop, as well as for broadcasters and cable distributors of direct injection programs. The Electronic Commerce Act provides for a well-functioning notice-and-take-down system. It is also a special feature that a number of interpretation issues and legal conflicts are solved by the reports (official opinions) of the Copyright Experts Council (e.g. concerning, the concept of distribution, encrypted tv programs, file sharing, IPTV, and private copying from illegal sources).
