Abstract/Description:
The Copyright Act of 18 April 2001 and its implementing decrees group together almost all Luxembourg legal provisions relating to copyright, related rights (rights of performers, phonogram producers and broadcasting organizations) and databases. The Copyright Act has thus implemented the various European Directives applicable in this field, including enforcement measures such as the availability of descriptive seizures and preliminary injunctions. A few issues still require clarification, the most notable one concerning the question of the application of the private copy exception and the related fair compensation under Luxembourg law.
