Abstract/Description:
This chapter aims to identify a number of trends in the enforcement of the Commission Decisions ordering the recovery of State aid in Spain. Three main trends are identified in the chapter: (1) the emergence of significant uncertainty in relation to the recovery of State aid, particularly in some relevant cases involving large amounts of aid to be recovered; (2) the increasing observance by the Spanish judiciary, and particularly by the Supreme Court, of the Commission’s notice on the enforcement of State aid law by national courts; (3) the adoption of specific legal provisions to recover fiscal State aid. Spain is thus a useful case study to identify a number of more general trends in the enforcement of State aid at the national level.
