A Bill for
An Act to amend the Children and Young People Act
2008
The Legislative Assembly for the Australian Capital Territory enacts as
follows:
1 Name of Act
This Act is the Children and Young People Amendment Act 2010.
2 Commencement
This Act commences on the day after its notification day.
Note The naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).
3 Legislation amended
This Act amends the Children and Young People Act 2008.
4 Daily care responsibility for children and young
people
Section 19 (2) (c)
substitute
(c) on the advice of a dentist or dental therapist—consent to dental treatment, including minor dental surgery, for the child or young person.
5 New section 19 (6)
insert
(6) In this section:
dental therapist—
(a) means a person registered under the Health Practitioner Regulation National Law (ACT) Act 2010 to practise the health profession of dental therapist (other than as a student); and
(b) for an activity, includes a person mentioned in paragraph (a) holding limited or provisional registration, to the extent that the person is allowed to do the activity under the person’s registration.
6 Offence—mandatory reporting of abuse

(g) a person authorised to inspect education programs, materials or other records used for home education of a child or young person under the Education Act 2004;
7 Annual review report—prepared at least annually

(a) if the order is in force for 1 year or more—by, but not earlier than 1 month before, the anniversary of the day the order was made, in each year the order is in force;
8 Court may order sensitive information to be given or
produced
Section 866 (2)
omit
a document given to it under subsection (1) (b)

information given or produced to it under subsection (1)
