A Bill for

An Act to amend the Government Procurement Act 2001









The Legislative Assembly for the Australian Capital Territory enacts as follows:

1 Name of Act

This Act is the Government Procurement (Capital Metro) Amendment Act 2016

.

2 Commencement

This Act commences on the day after its notification day.

Note The naming and commencement provisions automatically commence on the notification day (see Legislation Act

, s 75 (1)).

3 Legislation amended

This Act amends the Government Procurement Act 2001

5 Section 24, new definitions

proposed light rail track—see the Planning and Development Act 2007

related to light raila notifiable contract is related to light rail if—

(a) the contract relates to the construction, ongoing operation and maintenance, repairs, refurbishment, relocation or replacement of—

(i) light rail track; or

(ii) infrastructure within, or partly within, 1km from—

(A) existing light rail track; or

(B) proposed light rail track; or

(b) the contract relates to a development proposal declared to be related to light rail under the Planning and Development Act 2007

, section 137B (Authority may declare development proposal related to light rail).

Examples—par (a) (ii)

1 temporary infrastructure for construction of light rail such as safety fencing, scaffolding, access roads and parking

2 depot facilities

28A Contents of register—contracts related to light rail to be published

The notifiable contracts register must include the following for each notifiable contract that is related to light rail:

(a) the information described in section 28 (1) (a) to (g);

(b) for a notifiable contract, and any notifiable amendment of the contract, held by the responsible Territory entity in electronic form—an electronic copy of the contract;

(c) where anyone can obtain a printed copy of the contract as made and of any notifiable amendment to the contract;

(d) anything else prescribed by regulation.

8 Dictionary, new definitions
