A Bill for
An Act to amend the
Pharmacy Act
1931
The Legislative Assembly for the Australian Capital Territory enacts as
follows:
1 Name of Act
This Act is the Pharmacy Amendment Act 2004.
2 Commencement
This Act commences on the day after its notification day.
Note The naming and commencement provisions automatically commence
on the notification day (see Legislation Act, s 75 (1)).
3 Legislation amended
This Act amends the Pharmacy Act 1931.
4 New section 48B
insert
48B Pharmacist to be lessee of premises
etc
A registered pharmacist must not carry on a pharmacy business as owner at
premises unless—
(a) the pharmacist is the lessee of the Crown lease for the premises;
and
(b) the Crown lease is registered under the Land Titles Act 1925;
and
(c) the Crown lease prohibits anyone other than the
pharmacist—
(i) controlling the way the business is carried on; or
(ii) requiring goods or services to be purchased from a particular
supplier; or
(iii) receiving any consideration worked out by reference to, or that
varies according to, the profits or takings of the business.
