A Bill for

An Act to amend the Road Transport (Third-Party Insurance) Act 2008













The Legislative Assembly for the Australian Capital Territory enacts as follows:



1 Name of Act

This Act is the Road Transport (Third-Party Insurance) Amendment Act 2008.

2 Commencement

(1) This Act (other than section 5) commences on the day after its notification day.

(2) Section 5 commences on the commencement of the Road Transport (Third-Party Insurance) Act 2008, section 86 (Time for giving notice of claim—nominal defendant).

Note The naming and commencement provisions automatically commence on the notification day (see Legislation Act, s 75 (1)).

3 Legislation amended

This Act amends the Road Transport (Third-Party Insurance) Act 2008.

4 Section 2

5 Time for giving notice of claim—nominal defendant

Section 86 (2) and note

(2) The notice of claim must be given under section 84 not later than—

(a) 3 months after the day the motor accident for the motor accident claim happened; or

(b) if the court orders a later day under subsection (2A)—the day ordered.

Note However, the time for giving a notice of claim for a claimant with a legal disability begins on the day after the day the claimant’s legal disability ends (see s 98).

(2A) A court may, on application, order that a notice of claim under section 84 may be given on a day more than 3 months after the day the motor accident for the motor accident claim happened if satisfied that the later day is reasonable in the circumstances of the case.
