Australian Capital Territory Current Acts Australian Capital Territory Current Acts(1) If an executor or administrator has given notices under section 64 and a claim against the estate is sent to him or her, the executor or administrator may serve a notice on the claimant calling the claimant to take proceedings to enforce the claim within a period of 6 months, and to duly prosecute the claim.
(2) If, after that period of 6 months has ended, that person does not satisfy the Supreme Court that he or she is duly prosecuting the claim, the court may, on application by the executor or administrator, make an order barring the claim against the executor or administrator, subject to any conditions that appear just, or make any other order the court considers appropriate.
