ADMINISTRATION AND PROBATE ACT 1929 - SECT 90

Grant of probate or administration despite appointment of public trustee and guardian

    (1)     Even though that—

        (a)     the public trustee and guardian is administering the estate of a deceased person under section 87B; or

        (b)     the public trustee and guardian has filed an election to administer the estate of a deceased person under section 87C; or

        (c)     the public trustee and guardian has been granted an order to collect and administer the estate of a deceased person under section 88;

the Supreme Court may grant probate of the will, or administration of the estate, of the deceased person to an appropriate person on the conditions it considers appropriate.

    (2)     An application for a grant under subsection (1) must be served on the public trustee and guardian in accordance with the rules.
