In this chapter, employment is taken to be contrary to the best interests of a child or young person if—
(a) for a child or young person under 15 years old who is required to attend a school or participate in an education course under the Education Act 2004
—it is likely to prejudice the ability of the child or young person to benefit from the education; or
(b) for a child or young person engaged in education or training—it is likely to prejudice the ability of the child or young person to benefit from the education or training; or
(c) it is otherwise likely to harm the child's or
young person's health, safety, personal or social development (including by
sexual or financial exploitation).
