DANGEROUS SUBSTANCES ACT 2004 - SECT 189

Review by internal reviewer

    (1)     The internal reviewer for an internally reviewable decision must review the decision.

    (2)     The review must happen within 5 business days (the 5-day period ) after the day the work health and safety commissioner receives the application for review of the internally reviewable decision.

    (3)     The internal reviewer must—

        (a)     confirm the decision; or

        (b)     vary the decision; or

        (c)     set aside the decision and substitute the reviewer's own decision.

    (4)     If the decision is not varied or set aside within the 5-day period, the decision is taken to have been confirmed by the internal reviewer.
