DANGEROUS SUBSTANCES ACT 2004 - SECT 64

Return of amended, suspended or cancelled licences

    (1)     A licensee commits an offence if—

        (a)     the licensee's licence is—

              (i)     amended under section 58 (Licence—application to amend by licensee); or

              (ii)     amended under section 59 (Licence—imposition etc of conditions on work health and safety commissioner's initiative); or

              (iii)     amended, suspended or cancelled under part 4.4 (Disciplinary action); and

        (b)     the licensee fails to return the licence to the work health and safety commissioner as soon as practicable (but within 7 days) after the day the licensee is told about the work health and safety commissioner's action.

Maximum penalty: 100 penalty units.

    (2)     An offence against this section is a strict liability offence.
