ENVIRONMENT PROTECTION ACT 1997 - SECT 93

Directions of Minister

    (1)     The authority must exercise the functions of the authority in accordance with any directions of the Minister under this section.

    (2)     The Minister must not give a direction to the authority in relation to a matter under—

        (a)     part 11 (Powers of authorised officers); or

        (b)     part 12 (Powers of analysts); or

        (c)     part 13 (Enforcement); or

        (d)     part 14 (Notification and review of decisions); or

        (e)     part 14A (Enforceable undertakings).

    (3)     A direction is a disallowable instrument.

Note     A disallowable instrument must be notified, and presented to the Legislative Assembly, under the Legislation Act
