LEGISLATION ACT 2001 - SECT 75A

Meaning of commences retrospectively

    (1)     An Act or legislative instrument commences retrospectively if it commences on a day or at a time earlier than the day after its notification day.

Note     A reference to an Act or legislative instrument includes a reference to a provision of an Act or legislative instrument (see s 7 (3) and s 12 (2)).

    (2)     A statutory instrument that is not a legislative instrument commences retrospectively if it commences on a day or at a time earlier than the day after the day it is made or, if it is required under an Act or statutory instrument to be approved (however described) by the Executive, a Minister or any other entity, the day after the day it is approved.
