MEDICINES, POISONS AND THERAPEUTIC GOODS ACT 2008 - SECT 96

Contravening licence conditions

    (1)     A person commits an offence if—

        (a)     the person is a licence-holder; and

        (b)     the licence is subject to a condition; and

        (c)     the person is reckless about whether an act or omission by the person contravenes the condition.

Maximum penalty: 200 penalty units, imprisonment for 2 years or both.

    (2)     A licence-holder commits an offence if the licence-holder contravenes a condition of the licence.

Maximum penalty: 50 penalty units.

    (3)     An offence against subsection (2) is a strict liability offence.
