(1) A person commits an offence if—
(a) the person imports a plant into the ACT; and
(b) the plant is—
(i) a native plant; and
(ii) a protected native species.
Maximum penalty: 100 penalty units, imprisonment for 1 year or both.

(2) A person commits an offence if—
(a) the person imports a plant into the ACT; and
(b) the plant—
(i) is a native plant; and
(ii) has special protection status.
Maximum penalty: 200 penalty units, imprisonment for 2 years or both.
Note Special protection status —see s 109.
(3) This section does not apply to the importation of native timber into the ACT.
