NATURE CONSERVATION ACT 2014 - SECT 219

Offence—take plant or plant reproductive material into reserve

    (1)     A person commits an offence if—

        (a)     the person takes a plant into a reserve; and

        (b)     the plant is a pest plant.

Maximum penalty: 30 penalty units.

    (2)     A person commits an offence if the person—

        (a)     takes plant reproductive material into a reserve; and

        (b)     leaves the plant reproductive material in the reserve.

Maximum penalty: 30 penalty units.

    (3)     An offence against this section is a strict liability offence.

    (4)     A person has the benefit of the chapter 9 exceptions for an offence against this section.
