POWERS OF ATTORNEY ACT 2006 - SECT 31
How does enduring power of attorney operate while principal has
capacity? (1) This section applies to an enduring
power of attorney that operates while the principal has decision-making
capacity.
(2) While the principal has
decision-making capacity, the power of attorney operates as a general power of
attorney in relation to property matters.
