Australian Capital Territory Current Acts Australian Capital Territory Current Acts(1) It is a defence to a prosecution of a person for an offence against this part if the person satisfies the court that the person could not have prevented the vehicle being driven, or allowed to stand, on a road or road related area while loaded unsafely.

In a proceeding for an offence against this part, it is
sufficient to prove a vehicle was loaded unsafely if the prosecution proves
the load on the vehicle was not placed, secured or restrained in a way that
met the standards prescribed by regulation.
