URBAN FOREST ACT 2023 - SECT 86

Tree management plans—notice of decision

    (1)     The decision-maker must give written notice of the decision on a tree management plan to the applicant (if any).

    (2)     If the decision is to approve the tree management plan, the decision-maker must also give written notice of the decision to the following:

        (a)     the lessee of, or custodian for, the land where the tree is located;

        (b)     if the tree is on leased land—the occupier of land that—

              (i)     adjoins the land where the tree is located; and

              (ii)     is within 50m of the tree;

        (c)     for a heritage tree—the heritage council;

        (d)     for an Aboriginal cultural tree—the heritage council and each representative Aboriginal organisation.

    (3)     However, the decision-maker need not give more than 1 notice to a particular person.

    (4)     The decision-maker may give written notice of the decision to anyone else the decision-maker considers appropriate.
