Foreign confiscation orders—registration

A foreign confiscation order, or an amendment of a foreign confiscation order, is registered when details of the order or amendment are included in the register.

title="Act 1987 No 85 (Cwlth)">Mutual Assistance in Criminal Matters Act 1987

(Cwlth), s 34A (5) (Registration of foreign confiscation orders), and the

title="Act 1995 No 18 (Cwlth)">International War Crimes Tribunals Act 1995

(Cwlth), s 45 (2) (Registration of order) provide for foreign confiscation orders (and amendments) to be registered in the Supreme Court of a State or Territory where the property (or part of the property) that is the subject of the order is believed to be located. Registration is required by those provisions to be in accordance with the rules of court.
