COURT PROCEDURES RULES 2006 - REG 5802

Question referred to Supreme Court—form

    (1)     A question referred to the Supreme Court must be in the form of a special case.

.

    (2)     The special case must—

        (a)     state the questions to be decided; and

        (b)     briefly state the facts, and be accompanied by all documents, necessary to allow the Supreme Court to decide the questions raised by the special case; and

        (c)     be divided into paragraphs numbered consecutively.

    (3)     If the special case is to be presented in writing under part 5.8 (Written cases), the special case must state that it is to be presented in that way.
