COURT PROCEDURES RULES 2006 - REG 5807

Special case to Supreme Court—insufficient statement of case

    (1)     This rule applies if it appears to the Supreme Court that the special case does not state the facts, and be accompanied by the documents, necessary to allow the Supreme Court to decide the questions raised by the special case or otherwise to hear and decide the proceeding on the special case.

    (2)     The Supreme Court may—

        (a)     with each active party's agreement, amend the special case; or

        (b)     send the special case back to the initiating party for the party to amend the special case in the way stated by the court; or

        (c)     for a proceeding that is a civil proceeding—receive evidence, make findings of fact, and amend the special case accordingly.

Note     Pt 6.2 (Applications in proceedings) applies to an application for an order under this rule.
