COURT PROCEDURES RULES 2006 - REG 5832

Question referred to Court of Appeal—form

    (1)     A question referred to the Court of Appeal must be in the form of a special case.

.

    (2)     The special case must—

        (a)     state the questions to be decided; and

        (b)     briefly state the facts, and be accompanied by all documents, necessary to allow the Court of Appeal to decide the questions raised by the special case; and

        (c)     be divided into paragraphs numbered consecutively.

    (3)     If the special case is to be presented in writing under part 5.8 (Written cases), the special case must state that it is to be presented in that way.
