COURT PROCEDURES RULES 2006 - REG 6101

Documents—compliance with approved form

    (1)     If an approved form for a document requires particular information to be included in the document or a particular document (including an annexure or exhibit) to be attached to, or filed with the document, the document is properly completed only if the requirement is complied with.

Note 1     Substantial compliance with an approved form is otherwise sufficient (see

title="A2001-14">Legislation Act

, s 255 (4)), unless the href="http://www.legislation.act.gov.au/a/2001-14" title="A2001-14">Legislation Act

, s 255 (5) applies (see note to r (3)).

Note 2     The court may, by order, dispense with compliance with these rules (see r 6 (Dispensing with rules)).

    (2)     Subrule (1) has effect despite the href="http://www.legislation.act.gov.au/a/2001-14" title="A2001-14">Legislation Act

, section 255 (6).

    (3)     To remove any doubt, this rule does not affect the href="http://www.legislation.act.gov.au/a/2001-14" title="A2001-14">Legislation Act

, section 255 (5).

Note     Under the

, s 255 (5), if a form requires any of the following, substantial compliance with the form is not sufficient and the form is properly completed only if the requirement is complied with:

        (a)     the form to be signed;

        (b)     the form to be prepared in a particular way (for example, on paper of a particular size or quality or in a particular electronic form);

        (c)     the form to be completed in a particular way;

        (d)     particular information to be included in the form, or a particular document to be attached to or given with the form;

        (e)     the form, information in the form, or a document attached to or given with the form, to be verified in a particular way (for example, by statutory declaration).
