COURT PROCEDURES RULES 2006 - REG 6752

Tendency evidence notice

A notice of intention to adduce tendency evidence under the title="A2011-12">Evidence Act

, section 97 must be in accordance with the form approved under the href="http://www.legislation.act.gov.au/a/2004-59" title="A2004-59">Court Procedures Act 2004

, section 8 for section 97.

Note     The title="A2011-12">Evidence Act

, s 100 (1) provides that the court may, on the application of a party, direct that the tendency rule is not to apply to particular tendency evidence despite the party's failure to give notice under s 97.
