Note to div 2.9.4
The Magistrates Court may make an order under this division only in relation to a proceeding that the court has jurisdiction to hear and decide. For example, the court may not make an order under this division before a proceeding is started (see
title="A1930-21">Magistrates Court Act 1930, s 257 (Personal actions at law—amount or value) and s 258 (Power of court to grant relief)).
