WORK HEALTH AND SAFETY REGULATION 2011 - REG 198

Information to be obtained and provided by supplier

A supplier of plant must—

        (a)     take all reasonable steps to obtain the information required to be provided by the manufacturer under the title="A2011-35">Act

, section 23 (4) (a) and (c) (Duties of persons conducting businesses or undertakings that manufacture plant, substances or structures) and this regulation; and

        (b)     ensure that, when the plant is supplied, the person to whom the plant is supplied is given the information obtained by the supplier under paragraph (a).

Maximum penalty: tier G monetary penalty.

Note     Strict liability applies to each physical element of each offence under this regulation, unless otherwise stated (see  s 6A).
